These Terms and Conditions ("Terms") govern your access to and use of our website, mobile applications, and all related services (collectively, the "Platform"). "Third-Party Stations"	Radio stations whose live streams are aggregated and made accessible through the Platform.

2. Eligibility

By using the Platform you represent and warrant that:

1. You are at least 13 years of age. Users under 18 must have the consent of a parent or legal guardian.
2. You have the legal capacity to enter into a binding agreement under the laws of Kenya.
3. Your use of the Platform does not violate any applicable law or regulation, including the laws of the Republic of Kenya.

3. Description of Services

Radio.co.ke provides a free online platform that aggregates live audio streams from Kenyan radio stations. Our services include:

• Live Streaming — Access to live broadcasts from a wide variety of Kenyan radio stations covering music, news, talk shows, sports, gospel, and vernacular programming.
• Station Discovery — Browse and search stations by region, genre, or language.
• Favourites — Save your preferred stations for quick access.

We do not produce, control, or edit the audio content broadcast by Third-Party Stations. We act solely as an aggregator and directory of publicly available streams.

4. User Accounts

Certain features of the Platform may require you to create an account. If you register an account, you agree to:

1. Provide accurate, current, and complete information during registration.
2. Maintain and promptly update your account information.
3. Keep your password confidential and not share it with any third party.
4. Accept responsibility for all activity that occurs under your account.
5. Notify us immediately at Contact us Form if you suspect any unauthorised access.

We reserve the right to suspend or terminate any account at our sole discretion, with or without notice, if we believe a violation of these Terms has occurred.

5. Acceptable Use

You agree to use the Platform only for lawful purposes. The following activities are strictly prohibited:

• Recording, downloading, redistributing, or re-broadcasting any audio streams without the express permission of the originating station.
• Using automated tools, bots, scrapers, or similar technology to access, index, or extract data from the Platform.
• Attempting to interfere with, disrupt, or compromise the integrity or security of the Platform, its servers, or networks.
• Impersonating any person or entity, or misrepresenting your affiliation with any person or entity.
• Uploading, transmitting, or distributing any malware, viruses, or harmful code.
• Using the Platform for any commercial purpose, including advertising or solicitation, without our prior written consent.
• Circumventing, disabling, or otherwise interfering with any security-related features of the Platform.

Violation of these rules may result in immediate suspension of your access and, where appropriate, referral to relevant law enforcement authorities.

6. Intellectual Property

6.1 Our Intellectual Property

All intellectual property rights in the Platform — including but not limited to the website design, logos, code (HTML, CSS, JavaScript), graphics, and trademarks — are owned by or licensed to Radio.co.ke. You may not copy, modify, distribute, sell, or lease any part of our Platform without express written permission.

6.2 Station Content

The audio content, station names, logos, and associated trademarks belong to their respective owners (the Third-Party Stations). Radio.co.ke does not claim ownership over any Third-Party Station content.

6.3 User-Generated Content

If you submit any content to the Platform (such as comments, reviews, or suggestions), you grant us a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute such content in connection with the operation of the Platform.

7. Third-Party Content and Links

The Platform may contain links to third-party websites, advertisements, or services that are not owned or controlled by Radio.co.ke. We do not endorse, guarantee, or assume responsibility for the accuracy, content, or practices of any third-party site or service.

Your interactions with third-party sites — including any transactions, data sharing, or disputes — are solely between you and the relevant third party. We strongly encourage you to review the terms and privacy policies of any third-party site you visit.

8. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms.

We are committed to complying with the Kenya Data Protection Act, 2019 and all applicable data protection regulations. In summary:

We do not warrant that any particular radio station stream will be available at any given time. Stream availability depends on the Third-Party Stations and factors beyond our control, including internet connectivity and station server status.

10. Limitation of Liability

To the fullest extent permitted by Kenyan law:

1. Radio.co.ke, its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Platform.
2. We bear no liability for the content, quality, or legality of any broadcasts originating from Third-Party Stations.

11. Indemnification

You agree to indemnify, defend, and hold harmless Radio.co.ke, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:

1. Your use or misuse of the Platform.
2. Your violation of these Terms.
3. Your violation of any law or the rights of any third party.
4. Any content you submit to the Platform.

12. Termination

We may, at our sole discretion and without prior notice, suspend or terminate your access to the Platform for any reason, including but not limited to a breach of these Terms.

Upon termination, the following provisions survive: Sections 6 (Intellectual Property), 9 (Disclaimers), 10 (Limitation of Liability), 11 (Indemnification), and 13 (Governing Law and Disputes).

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya.

Any dispute arising out of or in connection with these Terms shall be resolved as follows:

1. Informal Resolution — The parties shall first attempt to resolve any dispute through good-faith negotiation within 30 days of written notice.
2. Mediation — If informal resolution fails, the dispute shall be referred to mediation under the Nairobi Centre for International Arbitration rules.
3. Litigation — If mediation fails, the courts of Nairobi, Kenya shall have exclusive jurisdiction.

14. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. When we make material changes, we will update the "Effective Date" at the top of this page and, where possible, notify users through the Platform.
